By contracting eSight Solutions for digital development, custom ERP software, mobile applications, or WhatsApp automation platforms, you signify your agreement to be bound by these Terms and Conditions.
These terms constitute a binding legal agreement between the client (corporate entity or individual) and eSight Solutions. We reserve the right to modify these terms at any time. Changes will be posted on this page with the updated "Last Updated" date.
eSight Solutions provides custom digital engineering, consultancy, and brand strategy services. The exact specifications, delivery schedules, and scope of work are detailed in individual Project Proposals and Service Level Agreements (SLAs).
Development is executed iteratively based on mockups and design specifications approved by the client. Changes to approved designs are subject to scoping review and additional billing.
Post-launch support is provided under separate maintenance schedules. We do not guarantee uninterrupted server uptime or third-party API availability beyond defined SLAs.
We respect code integrity and brand ownership. Our intellectual property provisions govern all digital deliveries:
Upon receipt of full and final payment, ownership of custom-designed assets, graphics, client-specific website copy, and custom code modules is transferred completely to the client.
eSight Solutions retains ownership of pre-existing software templates, development libraries, proprietary tools, and background codes used to construct the services.
Billing cycles are structured to ensure development progress matches financial milestones:
A non-refundable deposit (typically 30-50% of estimated cost) is required to schedule design and architecture resources.
Invoices are generated upon completion of defined stages (e.g., UI approval, beta release, final integration). Payments are due Net-15 days from invoicing.
Overdue accounts beyond 30 days are subject to interest penalties, and eSight reserves the right to suspend development or pause active hosting services.
Successful engineering requires collaborative participation. The client agrees to provide necessary brand assets, database accesses, and timely feedback loops.
You agree to supply text copy, image parameters, brand guides, and third-party login permissions in standard digital formats within scheduled timelines.
Delays in review or approval cycles (exceeding 7 business days) will automatically slide project timelines and milestones downstream.
To the maximum extent permitted by law, eSight Solutions delivers all digital services on an "as-is" and "as-available" basis without any express or implied warranties.
In no event shall eSight Solutions be liable for indirect, incidental, or consequential damages (loss of profits, data breaches, server downtime). Our total liability is capped at the total amount paid by the client under the specific project scope.
We integrate external services (WhatsApp API, payment portals, analytical maps). We cannot be held liable for disruptions, pricing shifts, or deprecations of these external services.
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of India. Any litigation, dispute, or arbitration arising from our services shall fall under the exclusive jurisdiction of the competent courts in Kerala, India.
